These terms are the agreement between you and Small Batch Cigar, 3744 East Chapman Ave, Suite E, Orange, CA 92869, when you use smallbatchcigar.com or buy from us. You accept them when you place an order. If we change them, we'll post the new version here with a new effective date, and the version in effect when you order is the one that applies to that order.

Age

You must be 21 or older to use this site or buy from us. That is the minimum age for tobacco purchases under US federal law. We ask for your date of birth when you create an account, we verify age and identity on orders, and we may hold or cancel any order we can't verify.

Your account

You need an account to order. Keep your details accurate and your password private. You're responsible for orders placed through your account, so tell us right away if you think someone else has used it.

Orders and pricing

• Prices are in US dollars. Applicable taxes are shown at checkout before you pay.
• An order is accepted when we ship it. We may refuse or cancel an order before then, for example if we can't verify your age or identity, suspect fraud, or can't ship to your address. If we cancel, you're not charged, or any charge is refunded.
• If a product is listed at the wrong price, we may cancel orders placed at that price, including after your card has been charged. If so, we refund the charge in full.
• Product photos and descriptions are as accurate as we can make them, but cigars vary, and packaging and bands change.

Payment

Card details are entered into a secure form provided by our payment processor and go directly to them. We never see or store your full card number. If you save a card for future orders or a club membership, the processor stores it, not us, and you can remove it in My Account.

Shipping and delivery

We ship only within the United States, and we can't ship to every state. On your first order the shipping address must match your billing address, and we don't ship first orders to forwarding addresses. Shipping times, carriers and damaged-package steps are on our Shipping page, which is part of these terms.

Returns

If something is wrong with your order, contact us within 7 days of delivery. Returns of undamaged, correct items are at your cost, and items must come back in the condition they were shipped. The full policy is on our Return Policy page, which is part of these terms.

Cigar of the Month Club

The club, offered on smallbatchcigar.com, is a monthly subscription that renews automatically. Here is how it works:

• Billing: when you subscribe, we charge the club price you chose. Standard shipping is free; if you choose a shipping upgrade, that's added. We charge the same amount on the same day each month until you cancel.
• Changing clubs: to move to a different club, cancel your current one and subscribe to the new one.
• Cancelling: cancel any time in My Account under Club Subscriptions, or by emailing [email protected]. Cancelling stops all future charges. A month that has already been charged ships as normal and isn't refunded.
• Selection: we choose the cigars, and the selection changes every month. Substitutions happen when a cigar is unavailable.

Reward points

On smallbatchcigar.com you earn 1 point for every $1 you spend on eligible items, and 100 points are worth $5 off a future order once you have at least 200 points. Some items don't earn points, mainly samplers, surprise packs, the club, SBVIP and gift cards. Points don't expire, have no cash value, can't be transferred, and are reduced if an order is cancelled or refunded. We can change or end the program, and we'll post notice here if we do.

Coupons and gift cards

Coupon codes must be entered at checkout, can't be applied to earlier orders, and can be withdrawn at any time. Gift cards can't be exchanged for cash except where the law requires it.

Our content and brands

The text, photos and design of this site belong to Small Batch Cigar and may not be copied or reused without our permission, other than to shop here. The Small Batch Cigar name and logo are our trademarks. Cigar brand names and logos belong to their makers, and we use them to identify the products we sell.

We link to other websites, such as manufacturer and brand pages. They aren't under our control and have their own terms and privacy practices.

Disclaimers and limits on liability

We provide this site as is. We do our best to keep it accurate and available, but we don't promise it will always be error-free or uninterrupted. To the extent the law allows, our products are sold without implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. To the same extent, Small Batch Cigar isn't liable for indirect, incidental or consequential damages arising from the site or our products, and our total liability for any order is limited to what you paid for it. Some states don't allow these limits, so they may not apply to you.

You agree to cover any losses or legal costs we incur because you broke these terms or misused your account.

Disputes and other terms

California law governs these terms. Any dispute about the site or an order will be heard in the state or federal courts in Orange County, California, and must be brought within one year of when it arises. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later.

We may suspend or close an account, or stop offering the site, at any time; these terms still apply to orders already placed. If our business is sold, this agreement transfers to the new owner. We may send you notices by email to the address on your account or by posting them on the site.
